Terms and conditions
These terms and conditions govern access to and use of Ship My Website: the platform that lets you build a website with your AI, edit it, host it and publish it. By creating an account or subscribing to a plan, you accept them in full.
1. Who we are
Ship My Website is a service published by Skallup, a French SAS with a share capital of €64,900, registered with the Lille Métropole Trade and Companies Register under number 952 771 509, with its registered office at Bureau 3, 34 place du Général de Gaulle, 59800 Lille, France (“Skallup”, “we”). Contact: contact@shipmywebsite.com.
2. Who the service is for
The service is reserved for professionals (companies, freelancers, non-profits, agencies) using it for their business (“the Customer”, “you”). By subscribing, you confirm that you are acting for professional purposes and are authorized to bind the organization you represent.
3. The service
Ship My Website provides an online editor, an MCP connector and an API that let the AI assistant of your choice (Claude, ChatGPT, Cursor…) build and edit your website, along with hosting and publishing on your own domain name. Depending on your plan, the service also includes a CMS for your blog, visitor analytics, a cookie banner and an SEO agent. What each plan includes is described on the Pricing page. The service evolves regularly: a feature may be added, changed or removed, without significantly reducing what your current plan includes.
4. Your account
Access to the service requires an account created with accurate, up-to-date information. You keep your credentials confidential and are responsible for everything done from your account, including by the people you invite and the AI you connect to it. Let us know at contact@shipmywebsite.com without delay if you notice any unauthorized access.
5. Your AI
The AI assistant you connect is provided by a third party (Anthropic, OpenAI, Google…) under its own terms and, where applicable, with your own subscription or API key. Skallup is not responsible for how it works or for its answers. Content produced by an AI may be inaccurate: review it before publishing your website.
6. Plans, term and renewal
The free plan lets you try the service with no commitment and no online publishing; its limits may change. Paid plans are billed monthly or yearly. Monthly subscriptions have no minimum term and renew every month. Annual subscriptions run for 12 months and renew for successive 12-month periods. You can change plans at any time from your account: an upgrade applies immediately, prorated for the remaining period; a downgrade takes effect at the next renewal date.
7. Prices and payment
Prices are shown on the Pricing page, in euros excluding taxes; applicable VAT is added. Subscriptions are paid in advance by card through our payment provider Stripe: Skallup never has access to your card numbers. An invoice is issued at each renewal. If a payment fails, we will let you know; if it is not settled within 15 days, we may suspend the publishing of your websites. Any late payment automatically incurs the penalties provided by law and a fixed €40 recovery fee (articles L441-10 and D441-5 of the French Commercial Code). We may change our prices: the new price applies from your next renewal, and we will notify you at least 30 days in advance.
8. Cancellation by the Customer
You can cancel at any time from your account or by emailing contact@shipmywebsite.com. Cancellation takes effect at the end of the current period (month or year), and the service remains available until then. Any period that has started is due and is not refunded, unless we made an error.
9. Your website and content
Your website, its text, images and code belong to you. You only grant us the right to host, reproduce and display them as needed to provide the service. You can download your website at any time. You warrant that you hold the rights to the content you publish and agree not to publish any unlawful, misleading, defamatory or infringing content, or content contrary to public order. You are the publisher of your website: you alone are responsible for its content and for the legal notices that apply to it.
10. Use of the service
You agree not to use the service to send unsolicited messages, host malware or phishing pages, bypass its technical limits or deliberately overload it. If we find, or are notified of, clearly unlawful content or abusive use, we may remove that content or suspend the website concerned, and will let you know as soon as possible.
11. Ownership of the platform
The Ship My Website platform, its software, code, design and name belong to Skallup. During your subscription, we grant you a personal, non-exclusive and non-transferable right to use it. You may not copy, resell or decompile the platform. Unless you object by email, we may mention your organization’s name and logo and show your website as a reference.
12. Availability and backups
We do our best to keep the platform and your websites available at all times (best-efforts obligation), but cannot guarantee uninterrupted availability. Short interruptions may occur for maintenance, updates or security. Every saved version of your website is kept in its history; we also recommend downloading a copy from time to time.
13. Support
Support is provided by email at contact@shipmywebsite.com, Monday to Friday, 9 am to 6 pm (Paris time), excluding French public holidays.
14. Liability
Skallup is only liable for direct, proven damage caused by its own fault. It is not liable for indirect damage (loss of revenue, customers, data or reputation), for content published by its Customers, for the answers of their AI, or for third-party services (domain name registrar, AI provider…). In any event, its total liability is limited to the amounts paid by the Customer during the 12 months preceding the event giving rise to the claim, except in case of gross negligence or willful misconduct.
15. Personal data
Your account data is processed by Skallup as described in our privacy policy. For personal data related to your website (for example, that of its visitors), you are the data controller and Skallup acts as a processor within the meaning of Article 28 of the GDPR: it only processes this data to host and run your website, on your instructions, protects it, keeps it confidential, makes no other use of it and deletes it at the end of the contract.
16. Force majeure
Neither party is liable for a failure caused by force majeure within the meaning of Article 1218 of the French Civil Code. If the impediment lasts more than 30 days, either party may terminate the subscription without compensation.
17. Suspension and termination by Skallup
In case of a serious breach of these terms (unlawful content, abusive use, non-payment), Skallup may suspend the account after a formal notice that remains unanswered for 15 days, or immediately where the law or the platform’s security requires it, and then terminate the subscription. When a subscription ends, for whatever reason, your websites are taken offline; you have 30 days to download your content, after which it is deleted.
18. Transfer of the contract
Skallup may transfer your subscription to a company that takes over the operation of Ship My Website, in particular a company created for this service, provided that it informs you at least 30 days in advance. If you refuse the transfer, you may cancel at no cost before that date.
19. Changes to these terms
We may change these terms. We will notify you by email at least 30 days before any significant change takes effect; if you do not accept it, you may cancel before that date. If you keep using the service afterwards, the new terms apply.
20. Governing law and disputes
These terms are governed by French law. The French version prevails over its translations. In case of a dispute, we will first seek an amicable solution; failing that, the courts of Lille, France, will have exclusive jurisdiction, unless mandatory rules provide otherwise.
